Information on Processing and Protecting Personal Data

For MOSER, a.s., having its registered office at Kpt. Jaroše 46/19, 360 06 Karlovy Vary, ID No. 26361035, registered in the Commercial Register kept by the Regional Court in Plzeň File No.  B 1078, (the “Controller”), the protection of your personal data is important; therefore, we comply with the following principles to achieve their highest possible protection.

This declaration and the subsequent processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), (the  “GDPR”) and by Act No. 110/2019 Coll. on Personal Data Processing,  as amended.

We may change this declaration at any time, namely if the relevant legal regulation concerning the protection of personal data changes; therefore, we recommend that, in your own interest, you follow on our websites from time to time potential updates to this declaration.

You provide us with your personal data in connection with the purchase of our goods and services, and you can learn the more detailed information below on our processing of data provided by you.

Please note that you are not obliged to provide us with your personal data, but if you fail to provide us with some of your personal data, which we request, the range of products or services we can provide may be limited.

First, we would like to explain you some basic terms and concepts to help you better understand the following text of this declaration:

Personal Data

“Personal data means any information relating to an identified or identifiable natural person (data subject). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier (a name, a surname, an identification number, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.”

Data Subject

“Data subject means any natural person to whom personal data relates, and who can be identified or is identifiable from personal data.”

Personal Data Controller

“The Controller means a natural or legal person, who determines the purposes and means of the processing of the personal data and is primarily liable for such processing.”

Personal Data Processor

“The Processor means a natural or legal person who processes personal data on behalf of the Controller.”

Processing Personal Data 

“Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.”

Methods of Data Processing

We process the personal data provided by you in accordance with the principal of lawfulness under Article 6 of GDPR: (i) for the fulfilment of the purchase agreement and in relation to acts before entering into the agreement, (ii) for the fulfilment of the statutory obligation, i.e. namely in relation to obligations related the statutory liability of the seller or the guarantee provided, and (iii) for purposes of justified interests of the seller, as the controller, which also include the processing of personal data for purposes of direct marketing (through regular mail, electronic mail, or telephone) and marketing researches.

We use the personal data provided by you always only for the purpose for which the data were disclosed and we always inform the user of this purpose transparently.

Data We Process

Within business relationships, we collect the following personal data:

  1. form of address /academic title;
  2. first name;
  3. surname;
  4. contact address;
  5. e-mail address;
  6. telephone number (or numbers, if you provide us with this data);
  7. payment card details (if you used the card); and
  8. data on goods purchased.

Period of Keeping Personal Data 

We keep data for the period that is necessary for purposes of the performance of the agreement and then for the period that is necessary for the fulfilment of statutory obligations or protection of our rights (generally, for 5 years from the termination of the legal relationship between the seller and the purchaser). Data provided based on the subject’s consent will be kept for the period stated in the consent. If you exercise your right to be forgotten or withdraw the consent provided, the data will, of course, be kept for a shorter period.  

 Transferring Data – Further Processors

The controller is entitled to process personal data using both automated and manual methods, as well as via authorized processors. Personal data will be disclosed only to authorized employees of the controller or the processor only to the extent necessary for the purposes of processing. There is only minimal transmission of personal data onward to further processors, and all processing relationships are based on processing contracts in which our processors are obliged to take such measures as to secure the same level of personal data protection as is provided by our company. The information on companies which process personal data for the controller or perform market research may be obtained from the controller’s address.

Commercial Communications, Direct Marketing

Pursuant to Section 7 (3) of Act No. 480/2004 Coll., on Certain Information Society Services and on Amendments to Some Acts (the Act on Certain Information Society Services), as amended, we may use data provided by you for direct marketing within our contractual relationship that has already existed. This marketing communication will only concern our similar products or services. You are at any time entitled to object free of charge against the processing of your personal data for the purpose of the direct marketing. If you do so, your personal data will not be processed for such purposes any longer.

Cookies

To make our offer relevant to you, our websites  www.moser.cz and www.moser.com use cookie text files. Cookies are used to remember your preferences (such as the log-in information, language, font size, and other imaging preferences). This means that you do not have to enter such data again for a certain period. Our cookies do not identify the individual user, but they identify only the device used by you assigning a randomly generated identification code. As a user, you can switch off or limit the extent of cookies in your browser.  However, upon doing so, you will not be able to use all functions offered by our websites.

Security

We use certain security technologies and functions to achieve the highest possible level of protection for the personal data provided by you. However, even though we make every effort to protect your personal data against loss, misuse, unauthorized access, modification, or disclosure, it is impossible to reach 100% control. Therefore, we will immediately inform you should any incident reach a certain level of risk.

Rights of Data Subjects

We respect the principle of transparency in processing personal data and, therefore, we will be pleased to provide you with the information on personal data we process in relation to you through contacts stated below.  

Firstly, you are entitled to access personal data that we process in relation to you. This right in particular consists in obtaining a confirmation that we process your personal data and also the right to certain further information, such as the purpose of processing, the category of specific personal data, the planned period of their processing, etc. 

If it is possible on the basis of the law, you have the right to change or rectify personal data we keep in relation to you.

You have the right to the restriction of the processing of personal data. If personal data are processed based on your consent, then you have the right to restrict this processing, withdraw the consent, or even have all data we keep based on your consent erased, except for cases in which the processing is based on a statutory obligation or for the reason of our legitimate interest.

You have also the right to obtain the copy of your personal data which we keep in relation to you, including their sources, purposes, methods of processing, and electronic decisions, as well as subjects with which we share your data. We will attempt to make the information you request available to you within a reasonable period. Depending on the type of the information you request, we may charge you a small fee within the extent prescribed by the valid laws. You are entitled to personal data portability under the terms and conditions set out by legal regulations.

If you believe that the controller conduct is in conflict with valid legal rules and regulations when processing your personal data, then you have the right to object against such processing, as well as the right to file a complaint at the Office for Personal Data Protection.
